Rourke & Blumenthal Achieved Fantastic Results in Two Complicated Medical Negligence Cases

Rourke & Blumenthal is proud to announce that Mike Rourke and Rob Miller recently achieved two fantastic results on behalf of clients in complicated medical negligence cases against The Ohio State University Wexner Medical Center.

The first case involved allegations that medical providers at OSUWMC failed to properly assess and diagnose spinal compression that occurred during an MRI study, resulting in the patient suffering paraplegia. Unfortunately, the patient died from unrelated reasons while his lawsuit was still pending, but R&B continued his fight on behalf of his family. No settlement offer was made by OSU prior to trial on the issue of liability. After a hard-fought two-week trial involving multiple expert witnesses, Mike and Rob successfully proved that the medical providers were negligent in their care of this patient. This is believed to be the first verdict in favor of a patient against OSUWMC in a medical negligence case in approximately ten years. The case thereafter settled for $940,000.

Mike and Rob successfully achieved a settlement of $4.9 million against OSUWMC a few months later in a case involving the misplacement of a central line into a patient’s artery instead of her vein. This error caused medications to be improperly routed directly to the patient’s brain resulting in repeated strokes that caused permanent injury. This case required Mike and Rob to build a team of the best medical and financial experts from all over the country to prove negligence and the impact of the negligence on the patient and her family. On the brink of trial, justice was achieved when the case settled for $4.9 million.
